Ladies and gentlemen of the Ethics committee, I thank you for taking the time to gather for this appeals hearing.  We are all here for the same reason.  To get to the bottom of this horrible scandal that has scarred the league. 

The suspensions of John Spurgeon and David Wilson are highly controversial and due to strange and convenient so called coincidences that have surrounding this case, we are not only appealing the suspension, but pointing a finger of suspicion directly at one man for this entire scandal... Michael Powers.

Ladies and gentlemen, I am the HIFLPA's attorney, Lauren Phillips, I am here as an advocate not only for John Spurgeon and David Wilson, but also as an opposition to several wrong doings over the past several weeks at the hands of GM Kirk and GM Powers.    

       
     





My name is Michael Clayton, I am the representative for the league in this case, I will be working on the side of the suspensions being upheld, and will work to stand firm that the decisions made by the league were the right ones..

You know John Spurgeon better than anyone and spend the most time with him in training. Have you ever witnessed him using drugs or suspected him of doing so? Have you known him to use any sports supplement powders, suspicious or otherwise?

Mr. Mangum cited David Wilson's association with disgraced Coach Seau as the only supporting evidence for his contested test results. Was Mr. Wilson's name included in your report of your extensive investigation into Coach Seau and his role in PED use in the HIFL?
 
   

       
 




His name was not included in my list, I mention in the report that some names were excluded for various reasons, I only listed players and coaches who I had evidence that I believed to be indisputable.

Governor Turpin, did you have any records or reports of Mr. Wilson being connected to Coach Atreyu Seau?
 
   

       
 




Mr. Wilson was one of the names I excluded from my report.    
     






What information lead you not to name Mr. Wilson in your report?
 
   

       
 




While I knew of Mr. Seau and Mr. Wilson's connections, I did not have any evidence of his using the PED's that I believed him to be connected to.  He was never seen by anyone I interviewed, and no one had heard him talking about usage.  that in combination with his lack of production on the field early in his career, I felt that he was not a suitable subject for drug use, however since his arrival in Music City and then New Jersey, I would potentially reconsider some of that logic..    
     





Governor Turpin, are you also aware that the correlation between David Wilson's abilities and the foot surgery he had in the pre-season in his first year with Music City?  That surgery was done to correct an injury that he had since his time in college.

The investigation was not originally supposed to be "much less extensive".  It was intended to be equal in size and scope to New Jersey's.  However, under threat of strike from the HIFLPA, I had no choice but to scale the testing back to using only urine specimens, instead of the blood and hair.

Also, the additional $250K was for an expedited process.  I did not wish to wait the 2 weeks that New Jersey had to wait.  Moving my tests to the front of the queue cost me more money.

So, Mr. Powers... How did you contact Mr. Mangum?  The league's open transcript lines do not show any history of a call between yourself and Mr. Mangum before you sent your payment.

The owners keep transcripts of phone calls in order to avoid any misuse of funds.  This is not a league mandate, it is done by the owners...

I wasn't in the office at the time.  I was commuting home, and happened to catch a replay of GM Kirk bashing me yet again in one of his press conferences.  I wanted there to be no doubts about the cleanliness of my locker room, post-Malone suspension mind you.  So I called Mr. Mangum.

Isn't it true that you didn't request a refund on the excess funds when the HIFLPA blocked blood and hair tests because you had already paid that money to frame key players on the Dragons' roster?

Everything but the last 8 words of his statement is true.  I didn't request a refund because I had already paid for the testing, and the expediting of said testing.  The fact that a situation arose between myself and the Players Association has no bearing on Mr. Mangum, or his work.

Asking for a refund would be amateur hour.  You don't rise to the position of a General Manager in the greatest sports league in the country by being an amateur.

I told Mr. Mangum that I was interested in an investigation of the Outlaws.  He described the process he would use....the interviews, the hair samples, the blood samples....and told me the time table was 2 weeks for results.  This was the same process, and fee, that New Jersey agreed to.  I asked if there were an option to move the Outlaws samples to the front of the line at the lab, so as the results would be available sooner.  Mr. Mangum indicated that for an extra fee, he'd be able to expedite the process.  Thus we landed on the time table, and pricing that we ended up agreeing upon.

The players were adamant that they were being advised by the HIFLPA to not cooperate, so I compromised and simply took one sample from each player and was extra careful not to lose or spill the samples.     
     






What was the chain of custody for the samples?    

       
 




The samples were taken from the players, labeled immediately, placed in my carrying case, and carried by me, to the lab technicians in Cincinnati, Ohio.  From there, I received the results by hand from the technician and returned them to GM Kirk afterwards.

..let me also take the time to clear the record, GM Kirk in public this week claimed that I "leaked" information to the media and to the league.  I told him from the start that he would receive the initial report one week before I submitted it to the league and published my findings, I did not violate our agreement in the slightest.

Mr. Mangum, how did GM Kirk react to your telling him that Mr. Spurgeon and Mr. Wilson failed their tests?     

       
 




He immediately asked me if the facility I used for testing was based in Tombstone. From that point on our relationship was strained.     
     






What was the next conversation you had with Mr. Kirk?    

       
 




I spoke to him a week later to inform him of the findings of my hair tests, I informed him that both players again failed these tests and he immediately informed me that he secretly had a new test, that he claimed was a "B" sample of blood from each player tested by the HIFL's league office.  He said those tests were not positive, and asked me to explain why my findings would be different, despite having a full week between my test and his.  Afterwards he questioned me why Tombstone had paid me more than he had, and at that point I decided I was done being treated as a hostile, and I left.  His final words to me were "you are right, you are done here. Get the fuck out."

Not entirely, no. I can't speak to the chain of custody and not taking a B sample seems suspicious considering it could be done by simply switching to a second test tube. I can't think why  player would choose to risk being found guilty by contamination without access to a second sample to clear his name. Mr. Mangum's approach to the investigation was amateurish and highly irregular. He didn't inform me of his decision to only take one sample until the following week, thus robbing me of the chance to properly verify his findings. I did the best I could. He also refused to tell me where his lab was when directly asked about it, choosing to act insulted by a throw away line instead, which I explained was made in jest. His overly strong reaction to the comment aroused my suspicion of GM Powers' involvement. I did indeed tell him to fuck off when it became clear to me that he had conned me out of $750k with his dishonest and amateur investigation, probably due to illicit payments he had received.

I would also like to mention that I have only made the comment about him leaking the report in private to my lawyer. I would like to know how Mr. Mangum had access to a privileged conversation. Did he plant a bug in my office as part of his mission to attack my team?

Objection, GM Kirk is not a licensed investigator, so his claims of amateurism or that methods are highly irregular are unfounded and reckless.

Furthermore his inflammatory claims of dishonesty are detrimental.

initially I expressed the HIFLPA's concerns with why we were against blood and hair testing, specifically that the league's CBA only allows for Urine testing, and also that blood testing shows drugs that may have already exited a players system in a typical urine test. He then told me that if my players did not like these tests, they really would have hated his original plan of hiring Jack Bowser for waterboarding and other torture, or as he called it, "Advanced interrogation." 

After that we did not speak until after John and David failed their illegal blood tests.  He told me that he wanted to retest the blood and that if it came back clean it would help the PA's argument against blood testing in the future.  I told him that the HIFLPA could not endorse or condone this, as it would make us weak in future arguments against GM's over stepping their authority.   He asked for quiet cooperation, saying that he would allow us to criticize him in public, to save face. ...I told him that I would think about it.

I wanted to clear our players names, and knowing that a week later the blood tests were less likely to show a positive result, I felt it was a good chance of success.    
       





What was your conversation with GM Powers like?
 
   





We spoke about our potential protest and he asked if we would continue to protest if he decided to not test blood and hair, and only conduct the Urine Tests.  I informed him that we would not protest or contest any suspension that came from a urine test, as it is approved by the CBA, and he agreed to reduce the scope of his investigation.

After reviewing the Committees findings, the league has decided...
















John Spurgeon and David Wilson failed a team issued, independently tested drug test, not once but twice.

Their failure to provide a suitable "B" sample prevented a true follow up test that could clear their names, and the committee has decided that the league administered test can not be accepted as evidence due to the league's own violation of the Collective Bargaining Agreement.














The league will pay a $5MM fine into the HIFLPA players fund as a result of this violation. However the suspensions of Mr. Wilson and Mr. Spurgeon have been uphe----.
